The road up to cottage country in Ontario passes through Barrie, a city of slightly more than 150,000 on the western edge of Lake Simcoe. With the natural beauty of a freshwater lake setting providing a pleasant gateway to the north and its proximity to the Greater Toronto Area, Barrie is also the centre of operations for personal injury law firm Oatley Vigmond LLP, a regular member of Canadian Lawyer’s top personal injury boutiques list.
“It’s hard to believe we’ve been around for about 50 years,” says founding partner James Vigmond, though noting it will be 20 years this year that the firm has transitioned from a full-service firm to one specializing in personal injuries. It’s grown over that period to a complement of nearly 100 partners, lawyers and staff.
Oatley Vigmond also has one of the broadest coverage areas in Ontario, with satellite offices in Toronto, North Toronto, Sudbury, Hamilton and North Bay. While the pandemic has meant the idea of using virtual means of meeting with clients has grown, Vigmond feels there is still a need for the “personal touch” of a local office, though that might change as people get used to doing business on Zoom.
The decision to specialize in personal injury law was a relatively easy one to make, Vigmond says, as “more and more, people with personal injury claims are looking for expertise and experience, something a full-service solicitor doesn’t necessarily have.” At the same time, Oatley Vigmond prides itself on its intimate “we’re all family” ambiance.

Someone who enjoys that ambiance is associate lawyer Erin Murray. She joined the firm in May 2017, transitioning from an insurance defence practice. “I think the major difference between plaintiff’s work and insurance defence is that I am now working for a person with a life-altering injury.” She says. “It’s an emotional process. With insurance defence, you’re representing a policyholder, but really, an insurance company is calling the shots. An adjuster rarely expresses emotion when talking about a case. It’s a job for them. For our clients, it’s often the worst thing that has ever happened to them. Empathy is not optional in Plaintiff’s work.”
Murray adds that working with accident victims “means meeting a lot of good, but imperfect people who are struggling to adapt.” Helping accident victims requires “crafting a narrative out of the facts that explains who they were before their injury, what they lost, and whose responsible.” The best possible settlement or award for clients “comes down to fastidious preparation at every step and building a case compelling to a jury and unshakeable when scrutinized by opposing counsel.”
Both Vigmond and Murray worry that the current methods of compensation for both minor and serious injuries often don’t reflect the true cost to the economic, social and emotional lives of their plaintiffs. The statutory system for compensating minor injuries can be too rigid. At the same time, insurance policies of even $1 million don’t reflect how much is needed to give the seriously injured person all they need to live the best life possible.
Says Vigmond: “That’s why I am very proud that we have developed a reputation of persuading courts on what our clients need and being clear that we are prepared to wrestle with the insurance companies who generally want to hold back.
“So I’m really proud of how we have approached the practice of law in changing times to the betterment of our clients. And I think that we’re seen as leaders in the personal injury field.”
