Richard M Bogoroch is the founder and managing partner of Bogoroch & Associates LLP. He has over 35 years of experience practising personal injury and medical malpractice litigation. Richard is regarded as a leading personal injury lawyer and has been recognized by the Canadian Legal Lexpert® Directory (since its inception in 1997) and by The Best Lawyers in Canada, two leading peer-review lawyer-rating guides. Since 1993, he has been certified by the Law Society of Ontario as a Specialist in Civil Litigation.
Richard graduated from McGill University Law School with a BCL in 1978 and an LLB in 1979. He was called to the Alberta Bar in 1980 and the Ontario Bar in 1983. In 1995, he completed the Harvard Mediation Workshop sponsored by The Advocates’ Society. He is a past director of the Ontario Centre for Advocacy Training, a past director of The Advocates’ Society (1994-98) and a past chair of the Canadian Bar Association – Ontario Provincial Committee on the Judiciary. He is also a member of the Toronto Lawyers Association, the Medico-Legal Society of Toronto, the American Association for Justice, the American Bar Association, The Advocates’ Society and the Ontario Trial Lawyers Association. Richard has lectured and written extensively on many aspects of personal injury litigation, brain injury litigation, medical malpractice, and chronic pain litigation, for Continuing Legal Education Programs organized by the Law Society of Ontario, the Ontario Trial Lawyers Association, The Advocates’ Society, the Ontario Bar Association (formerly the Canadian Bar Association) and Osgoode Hall Law School’s Professional Development Program. He has also been an instructor for the Law Society of Ontario’s Bar Admission Course and Osgoode Hall Law School’s Intensive Trial Advocacy Workshop.
Since 1984, he has chaired, co-chaired and/or has spoken at over 100 programs of continuing legal education focused on various aspects of personal injury litigation, brain injury litigation, medical malpractice litigation and chronic pain litigation. Notably, he was the co-chair (2011-14) of The Advocates’ Society’s annual personal injury program, Tricks of the Trade. In addition, since 2005, Richard has chaired or co-chaired the Annual Update in Personal Injury Litigation organized by Osgoode Hall Law School’s Professional Development Program. From 2013 to 2016, Richard was appointed by the Government of Canada to serve as a director of the Patented Medicines Prices Review Board, an independent board established by Parliament in 1987 under the Patent Act to protect the interests of Canadian consumers by ensuring that the prices of patented medicines sold in Canada are not excessive. In 2015, he was honoured by the Ontario Trial Lawyers Association with the Dean Edgell Award for his significant contribution and excellence in legal writing, continuing legal education, and leadership activities.

The COVID-19 pandemic has meant some dramatic changes to how law is practiced, including at leading personal injury law firm Bogoroch & Associates LLP. But while the mechanisms of the law practice may differ from before the pandemic hit two years ago, what hasn’t changed is the firm’s determination to fight for its clients.
“We were already in good shape before the pandemic in dealing with the adaptations that were needed as a result of COVID,” says founder Richard Bogoroch, pointing to the firm’s long-term use of technology to create a safe, secure, and paperless office. In fact, it was the court system in general that was dragged out of the technological dark ages, and the firm was able to meet the new demands of a virtual court system from the start.
As well, both lawyers and staff at Bogoroch & Associates have been able to adapt to a hybrid work model with a significant work-from-home component, a system the firm doesn’t see changing back to a more traditional format anytime soon.
Says partner Heidi Brown: “With having to pivot to a more hybrid model, we have come to learn that people can work from home and be productive.” She also notes the use of virtual technology for everything from meetings and mediations to pre-trials and trials.

Cody is responsible for creating a positive and safe work environment and strives to promote safety as not only a policy but a lifestyle. He has initiated and implements a range of health, safety and environmental features that have been of critical importance to the overall safety objectives, operations, and profitability of Fillmore Construction. “In many respects, it is wonderful because we can spend less time travelling and more time focusing on cases more efficiently,” she says. Bogoroch also points out that the firm has been mindful to keep its culture alive and well even in a hybrid format, and to make sure that younger associates and articling students are able to be mentored by the firm’s senior practitioners.
Bogoroch adds that a lot of time and money can be saved when it comes to the expert witness most personal injury cases depend on. “It reduces the cost of litigation because the experts you rely on don’t have to travel to the courtroom to testify in person and wait for what may be only an hour or two of testimony,” he says. It can also widen the pool of potential expert witnesses because travel is not as important a factor.
One area of increasing concern, says Brown, is the “deductible” that stripped away from an injured person’s pain and suffering award, a policy that has been in place in Ontario since 2015. Under the Ontario Insurance Act, accident victims don’t receive the full value of such claims unless the claim exceeds $138,343.86. What’s more, if the value of the pain and suffering claim does not exceed the deductible, the injured person can be required to pay the insurance company’s legal costs.
Further, the amount of the deductible for pain and suffering increases every year. Prior to the 2015 change in insurance legislation, the deductible amount was $30,000, but from Jan. 1 until the end of this year, $41,503.50 will be deducted from awarded non-pecuniary damages (though it is waived in awards over the $138,000-plus figure). If the award is less than $41,503.50, the plaintiff might have to pay the insurance company for lawyers and
trial costs.
“That deductible limit goes up every year, tied to inflation, and increasingly swallows up any sort of award for pain and suffering,” says Brown. The solution would be to have the legislation that favours the insurance companies changed to better reflect the injuries an accident victim has suffered.
Until then, Bogoroch says, the lawyers at his firm will continue to fight for the “little guys” to get the awards they deserve.

As well, both lawyers and staff at Bogoroch & Associates have been able to adapt to a hybrid work model with a significant work-from-home component, a system the firm doesn’t see changing back to a more traditional format anytime soon.
Says partner Heidi Brown: “With having to pivot to a more hybrid model, we have come to learn that people can work from home and be productive.” She also notes the use of virtual technology for everything from meetings and mediations to pre-trials and trials.
