Norm Assiff of Edmonton-based Assiff Law Office says among the reasons his firm has gained a reputation for being one of the top personal injury boutiques is that “we take the cases other lawyers may take a pass on.”
“A lot of firms may not take a case because they think it’s not worth their time, but we like to take cases because we think it is part of a bigger cause,” he says. “We challenge insurers who consistently do things like deny benefits, or prematurely cut off clients from the benefits they need, because we hope it stops this behaviour from being repeated over and over.”
Assiff says that even though his firm is blessed with high volume, it can’t obviously take every case, “but we try to help every accident victim we can.” With little advertising, most of Assiff’s client list comes from referrals from past clients who have been pleased with the results achieved.
The firm, founded by Assiff in 2013, has grown from two staff members and one lawyer to a complement of 10 lawyers and 14 support staff. That growth has come from being able to successfully navigate through ever-changing insurance laws and regulations, most of which ultimately are “tweaked against the victims and in favour of the insurance company defendants.”
In Alberta, a huge change in personal injury law was the creation of the Minor Injury Regulation in 2004, which set up a system of compensation that Assiff says doesn’t recognize the true impact of an injury on a plaintiff’s life. The scope of injuries has been getting wider since then, with a greater number of them being considered “minor” when they actually are quite debilitating.
One of Assiff’s biggest victories was a case in Alberta’s Court of Queen’s Bench about a decade ago, where the court ruled that a tooth or jaw injury could not be considered minor because it met three criteria: the injury was not a sprain or strain or related to whiplash; the injury caused “serious impairment” preventing an injured person from engaging in normal daily living; and the Minor Injury scheme does not include dental injuries, with no provision for dental experts to evaluate or complete the necessary forms or to act as certified examiners.
The case not only makes it clear that dental and jaw injuries are not caught by the compensation limits set out in those regulations, it also very likely excludes those who suffer from any kind of chronic or long-term pain syndrome from falling under the Minor Injury Regulation.
Assiff set a precedent in another case, winning a ruling that compels an insurance-hired psychologist to have a camera in the examination room to ensure victims of negligence are treated fairly and that what is said or seen in the room are accurately and fairly recorded.
“When we take on cases, it’s not only for the benefit of that particular client, but for the benefit of the insurance system when it comes to the ‘little guy.’ It is why our motto is ‘We care,’” he says.
