In his almost 30 years as a lawyer, Joseph Neuberger has seen a lot of changes in how criminal law cases are handled. Perhaps the most striking difference from when he started out is the increasing complexity in how criminal cases play out these days.
“Over the years, criminal law has become a document-heavy process,” he says. Whether it is hard copy documents or electronic files, Neuberger says there
is much more being filed. In particular, he notices it in the sexual assault or domestic offence cases he takes on, an area where he has developed
an expertise.
A good example are recent additions to the Criminal Code, which puts the onus on the defence to make the case why evidence that would normally be expected to be private should be disclosed at trial. “There are more written motions, more advocacy these days,” Neuberger says.
While he has adapted to a world of electronic files being shared, Neuberger admits there is still great satisfaction in printing out a document and festooning it with sticky notes and highlighter as he reads through it. So, while he hasn’t changed “old school” ways in that respect, the management of electric documents has been a gamechanger, and their increased use is likely to continue in the Canadian legal system long after the COVID-19 pandemic
is over.
Neuberger started out as a commercial litigation lawyer after being called to the Bar in February 1993. However, he decided early on that criminal law is what he wanted to do. “Commercial litigation was not a structure I could thrive in,” he says, pointing to its more bureaucratic, corporate nature. “I liked the flexibility and challenge of criminal law.”
He points out that many criminal defence lawyers work on their own, or with one or two others. There are a lot more personalities in criminal law, those
who might have a work style that wouldn’t fit a larger firm. However, he says his firm – with five lawyers, two law clerks and two paralegals – works well “because we seem to mesh really well and there is a good dynamic here – we’ve been lucky”.
As for how criminal matters will be dealt with through the courts post-pandemic, Neuberger believes a hybrid system will evolve, characterized by more pretrial motions and administrative appearances done virtually. Virtual judge-alone trials and guilty pleas will also likely continue. “I have to admit I haven’t felt hampered in any way doing these proceedings, though I was a bit worried about losing the human element of a trial.”
As for jury trials, Neuberger thinks they will return as in-person proceedings once the pandemic is finally over. He says that jury trials have a role to play, and that he has seen jurors take their jobs very seriously.
“They do a very good job in listening to the evidence. And sometimes they have a far better sense of the evidence than we do because they’re not trained as lawyers, and they have a healthy dose of common sense and how people are like in the real world. And that’s why I think juries are still incredibly important in our justice system,” he says.
