Asked whether “litigator’s litigator” would be a good description for his firm, senior counsel Randy Kaardal, KC perks up, saying, “Yeah. I think that’s how we like to see ourselves — we get referrals, obviously, from clients but also from other lawyers who think we’d be suitable for a particular case or when something’s gone awry. One of the things that sets our firm apart is our breadth of practice. We have lawyers recognized by their peers as leaders in natural resource matters, commercial matters, criminal and regulatory matters, administrative matters, and labour and employment law.”
In fact, while Vancouver-based Hunter Litigation Chambers, founded in 2006, doesn’t typically do personal injury litigation, the Trial Lawyers Association of British Columbia and several motor vehicle plaintiffs retained the firm to challenge the BC government’s decision to send certain personal injury cases to the province’s Civil Resolution Tribunal on the grounds that the practice offended s. 96 of the Constitution Act 1867 by infringing on the jurisdiction of the superior courts.
A recent win for the firm involved a “frustration of contract” case. The BC Court of Appeal upheld the trial court’s ruling that MacKenzie Sawmill Ltd., whose Surrey mill was destroyed in a series of fires, was not “permanently discharged” from its obligations to provide Interfor Corporation, Hunter’s client, with wood chips. “Given the discussion over force majeure and frustration of contract during the pandemic, this is an important ruling,” Kaardal says.
“When speaking to clients, we emphasize the depth of experience our lawyers have, and a strong skill set that includes advocacy, trial work, mediation and arbitration,” he says. “We can handle dispute resolution with senior counsel, a mid-level band of lawyers who can step in and handle everything and get great results, and then our younger lawyers who are getting hands-on experiences in a variety of hearings and dispute resolution matters.”
Kaardal also points, with pride, to the firm’s experience and prominence in administrative regulatory work and what he calls public law. A couple of examples are the firm’s representation of a major participant in the province’s Cullen Inquiry into money laundering, and the successful constitutional challenge by the Amanda Todd Legacy Society to s. 486.4(3) of the Criminal Code, striking down the publication ban on a young person’s identity as unconstitutional.
As for which way the firm will grow in terms of practice area, Kaardal says, “litigation is organic”. Once you pick up a file in a particular area and succeed with it, “your name gets out there, and you get some prominence for taking on those types of cases,” he adds. “Often it is young, talented and bright people who can take those on. So that’s what I mean by growing organically.”
Hunter Litigation Chambers, which consists of more than 20 partners and lawyers, generally restricts its practice to dispute resolution, emphasizing commercial litigation and arbitration, class actions, labour and employment, criminal and regulatory, and constitutional and administrative law.
